These Terms of Service ("Terms") govern your use of the TakeawayFriend platform ("Service"). By creating an account or using the Service, you ("you", "the Restaurant") agree to be bound by these Terms.

The Service is operated by TakeawayFriend ("we", "us", "our"), based at 1/3 DunEden Business Centre, 8 Harrison Road, Dundee, DD2 3SN, United Kingdom.

These Terms apply to restaurant owners who sign up to use TakeawayFriend to take online orders. If you are a customer placing a food order, your purchase is with the restaurant, not with TakeawayFriend, and the restaurant's own terms apply.

Use of the Service requires a monthly subscription of £49 plus a one-time setup fee, both of which are subject to change with 30 days' notice. Subscription fees are billed monthly in advance and are non-refundable except as required by law.

You will be billed via the payment method you provide. If a payment fails, we may suspend your account until the issue is resolved.

When customers place orders through your TakeawayFriend ordering site, we process their personal data on your behalf. By accepting these Terms, you also accept our Data Processing Agreement, which forms part of these Terms.

We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may perform maintenance, updates, or repairs that temporarily affect availability. We will give reasonable notice for planned maintenance where possible.

9. Intellectual property

The TakeawayFriend platform, including its software, design, branding, and content, is owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service. Your menu, branding, and uploaded content remain your property; you grant us a licence to use them solely to provide the Service.

10. Limitation of liability

To the maximum extent permitted by law, TakeawayFriend's total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for:

Upon termination, your ordering site will be taken offline and your data will be handled in accordance with our Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
